Guardianship
For those individuals who do not have advance directives, the inability to make personal and financial decisions can result in the need for a court-appointed guardian.
The Elderlaw Firm can assist you in becoming appointed Guardian for your loved one, to handle personal and financial decisions. Many times, this is the only way to insure that your loved one will be secure and cared for. After you are appointed Guardian, the law imposes upon you strict responsibilities to take proper actions to protect assets, care for your loved one and to report to the court. We can help with the administration of the Guardianship to ease this burden for you.
Guardianship is a protective arrangement established by the court for an incapacitated person. For older adults, guardianships usually are established for those who have lost mental capacity due to dementia, major strokes, and severe mental illness; among other conditions. These incapacitated adults often need help with their medical treatment, residential placement, and the management of their financial affairs.
Guardianship should be considered as a last resort. It is complicated, time-consuming and expensive. However in some situations it is the right answer.
