Simply having your assets in a trust doesn’t protect you from Medicaid, unless it’s an Irrevocable Protector Trust.
The answer to that is I really don’t know without first seeing that Trust.
There are a lot of different types of Trusts. The most typical type of Trust is one that is set up to avoid probate. That’s court supervised estate of administration. Now that type of Trust does that job, but it does not protect assets from nursing homes.
And so if we’re worried about, “How do we best protect assets to make sure that we don’t go broke in a nursing home?” then we need to be looking more at an Irrevocable Protector Trust rather than a Revocable Trust.
So, you may have a trust, but it may not be protecting you right now.
